HPM + KTA Build a Special Easter Official Rules

*KTA Super Stores and HPM Building Supply Assumption of Risk and Warning of Risk Waiver and Release of Claims ("Assumption & Release")

Eligibility: You must be 18 years or older to participate or have parental/guardian consent signed and returned to KTA Super Stores and HPM Building Supply if awarded the prize. KTA + HPM Easter Giveaway is open only to legal residents of Hawaii Island. The Promotion is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law. KTA Super Stores and HPM Building Supply associates and their immediate family members are ineligible for the promotion.

Agreement to Official Rules: By participating in the giveaway, entrants fully and unconditionally agrees to and accepts these Official Rules and the decisions of the Sponsor and Administrator, which are final and binding in all matters related to the giveaway.

By participating in HPM x KTA Egg Hunt in any way, you acknowledge that you have fully read, understood, covenant and agree to this full Release Waiver.

Giveaway Period: The giveaway begins at 10:00 a.m. Hawaii-Aleutian Standard Time ("HAST"), March 18, 2020  and ends at 11:59 p.m. Hawaii-Aleutian Standard Time ("HAST"), April 11, 2020 (the "Giveaway Period"). Administrator’s computer is the official time-keeping device for this giveaway.

Promotion Results: KTA Super Stores and HPM Building Supply will conduct a random drawing for the one (1) Golden Egg Grand Prize and announce the winner no later than Friday, April 10, 2020. The ten (10) other prizes will be awarded during the Easter Egg Hunt. Clues will be given throughout the promotion period. The winner must follow the clues and find the prize. The person(s) to first find the hidden prize and bring the winning item to a designated KTA or HPM location will be awarded the prize(s). I agree to abide by any decision of an Event official relative to my ability to safely complete the Event, which decision is at the sole discretion of the Event official and I agree lack of a decision does not create any liability or waiver thereof whatsoever.

General Conditions: Each participant may only win one (1) prize throughout the Giveaway Period. In the event that the operation, security, or administration of the giveaway is impaired in any way for any reason, including, but, not limited to, fraud, technical failures, regularly scheduled maintenance, virus or other technical problem, the Sponsor may, in its sole discretion, either: (a) suspend the giveaway to address the impairment, then resume the giveaway in a manner that best conforms to the spirit of these Official Rules; or (b) cancel the giveaway and award the prizes in a random drawing from among all eligible entries received up to the time of impairment. I understand HPM x KTA Egg Hunt is an event subject to multiple safety considerations and acts of God, which may cause cancellation with limited notice.  Wind, rain, dry weather, and heat may cause delay, rescheduling, or cancellation.

Release and Limitations of Liability: You understand and agree that: By participating in HPM x KTA Egg Hunt, you assume all liability and responsibility for your actions and safety. HPM x KTA Egg Hunt and its Sponsors assume no liability or responsibility for your actions nor safety, nor the actions and safety of your friends, nor anyone affected by your or your friends actions. 

In consideration of being allowed to participate in any way in HPM x KTA Egg Hunt related events and/or activities (the “Event”), by participating in HPM x KTA Egg Hunt, I acknowledge, covenant and agree that:

I, for myself and on behalf of my heirs, assigns, personal representatives and/or next of kin, forever WAIVE, RELEASE, DISCHARGE and agree to hold KTA Super Stores, HPM Building Supply and their officers, directors, members, Directors, representatives, officials, principals, owners, licensees, franchisees, agents, affiliates and/or employees, subsidiaries and/or assigns, as well as their independent contractors, sponsoring agencies, sponsors, advertisers, volunteers and if applicable, owners and lessors of the premises used to conduct the Event (collectively “Releasees”) harmless, WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, ILLNESS, INCAPACITY, DAMAGES, EXPENSES, DEATH, and/or loss or damage to person or property incurred by me in connection with participation in the Event. I further agree to indemnify, defend and hold harmless Releasees from any loss, liability, cost, claim or damages arising from my participation in or association with the Event.

AFTER OPPORTUNITY TO FULLY INFORM MYSELF ABOUT THE EVENT, I KNOWINGLY AND FREELY ASSUME AND ACCEPT ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, and assume full responsibility and all risks of all nature for my participation in the Event;

Except where prohibited, by participating in the giveaway, entrants agree to release and hold harmless KTA Super Stores, HPM Building Supply and their respective parents, subsidiaries, affiliates, promotional partners, prize partners, agents and agencies, and the officers, directors and employees of each of them (the “Released Parties”) from and against any claim or cause of action arising out of participation in the giveaway or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the giveaway; (b) technical errors related to computers, servers, providers, printers or telephone or network lines; (c) printing errors; (d) errors in the administration of the giveaway or the processing of registrations and game pieces; (e) late, lost, or undeliverable mail; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the giveaway or receipt of any prize. Entrant further agrees that in any cause of action, the Released Parties’ liability will be limited to the cost of entering and participating in the giveaway and in no event shall the Released Parties be liable for attorney’s fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequenti, al, direct, or indirect damages. If for any reason an entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, entrant’s sole remedy is a duplicate package. If it is not possible to award another entry/play for any reason, Sponsor, in its sole discretion, may elect to hold a random drawing from among all eligible entries received up to the date of discontinuance for any prize offered herein. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth herein to be available and/or claimed, Sponsor reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims. 

Disputes: Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this giveaway or any prizes awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for Oahu (First Circuit) of Hawaii or the appropriate Hawaii State Court located in Honolulu County, Hawaii; and (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering any Promotion, but in no event attorneys' fees. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of Hawaii, without giving effect to any choice of law or conflict of law rules (whether of the State of Hawaii or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Hawaii. 

I acknowledge and verify that I may be dismissed from participation, if I endanger the safety or negatively affect the Event, a person, a facility or property of any type or kind.

In consideration and in return for being allowed to participate in the Event, I release and agree to hold KTA & HPM harmless the Releasees from all present and future claims regarding my participation in the Events that may be made by me, my family, estate, heirs or assigns.

I have read, understand and agree to obey all Event Rules and understand and agree that by breaking any of the Rules I may be disqualified from the Event and/or put myself and/or others at risk of accident, injury, damages or even death and I take full and complete responsibility for my actions.

Publicity: Except where prohibited, participation in the giveaway constitutes entrant’s consent for Sponsor and its designees to use entrant’s name, likeness, city and state of residence for promotional purposes in any media without further consideration. 

I hereby irrevocably, absolutely and in perpetuity, grant unlimited permission to the Releasees to film, videotape and record gratis the performance of the above named participant in the Event and subsequently to telecast, sell, distribute and other utilize the same in whatever manner Releasees deem appropriate. Such permission includes without limitation granting the unlimited and irrevocable right to Releasees, without compensation of any kind to me, to own, use, publish, copyright, reproduce, sell, distribute, or broadcast my name, nickname, image, likeness, voice, photograph, signature facsimile, or any other depiction of any kind of me or my likeness (collectively the “Images”), in connection with or due to my participation in the Event, in any electronic or print format or media or format whatsoever, whether such format is now known or later developed. I acknowledge and agree that Releasees and their representatives will have this unlimited right throughout the world.

Entrant's Personal Information: Information collected from entrants will be kept confidential to the Administrator, and will not be shared with any other parties/vendors other than what is included in paragraph.
